Re: FFL 07 Application Question
Check your state and local zoning laws/code. Would some other type of "light manufacturing" and shipping be allowed? Do you homework on this before you submit the FFL application.

Re: Ranking of Best States for gun owners
The criteria selected and the weight given to each factor determine the ranking, of course. I do not agree with Ohio being ranked so low, but it depends on what particular law cause you personal angst verses another person. For example, comparing Ohio to Pennsylvania: Ohio has shall-issue CCW, but r...

Re: Silencerco shotgun suppressor
I'm a bit mystified why they even mention that their company developed the rail system to contain the shot wad.Its a old patent re-purposed for use in a shotgun suppressor and they did not think that use first! I don't doubt you, but I'm curious as to where that configuration was used before. Got a...

Re: Silencerco shotgun suppressor
Well that answers the physical question, but seems to further open the can of worms that is the legal question; are these shorter rods not then 'silencer parts' according to the ATF rules? Would that not preclude their purchase without extra tax stamps for each rod or set of rods, or even eliminate...

Re: Silencerco shotgun suppressor
And aren't modular parts considered extra suppressor parts? If so, wouldn't that be illegal according to the ATF? Yes, they are considered extra suppressor parts, and therefore illegal. I assume Silencerco figured a legal way to do it, I have a request into FTB to find out how they did it as we hav...

Re: Sig suspends muzzle brake lawsuit vs ATF
I think you are all reading too much into this. Sig filed a civil action based on the ATF's administrative ruling. Just a few days before, the ATF had been smacked by a different court for being arbitrary and capricious in how it determined whether a device was a silencer (which included no sound le...

Unless the nomenclature has changed, you will not get a "permit" number. That is for import/export permits. You will get a reference or transaction number.

Re: Hello, new member introduction and trust vs llc question
For owning and estate planning, trusts and LLCs both have certain pros and cons. In many cases, an LLC is better, BUT some states require that you file a report and/or pay a fee every year to keep them in good standing. But, some states do not. For example, if you have a trust for NFA items and your...

Re: Transferring form 1 suppressor from Corp to a new Trust?
Was the corporation formed just to own/make NFA items? If so, why not just transfer ownership of the corporation to the trust? If the corporation owns other things and has some other purpose, that's not a good option. But if you are switching to a trust just for the estate planning benefits, you can...

Re: New machine guns legal for trust, possibly
My point is that NFA'34 says nothing about Trusts, its further definitions from other codified law that expands it to Trusts. It depends on what laws you consider to be part of "NFA '34." Clearly the tax code sections were added as part of the NFA when it passed. But they did not specific...

Re: New machine guns legal for trust, possibly
Can you please cite where in the National Firearms Act of 1934 it says trusts? I am not seeing it. I'll address this. You're right, it is not in Title 18 of the U.S. Code. Specifically, it is 18 U.S.C. (Crimes and Criminal Procedure), Part 1 (Crimes), Chapter 44 (Firearms), which is Sections 921-93...

Yep, would be interesting if manufacturers could sell the serialized tube and then you could buy as many mounts, endcaps, or cores as you want to swap between firearms and core designs...different designs for different applications (pistol vs. rifle, MG, etc.) Maybe wouldn't apply to cones that can...

Re: Sig jumps into the ring.....
This will be interesting. 18 USC 921(a)(24) says: The terms “firearm silencer” and “firearm muffler” mean any device for silencing, muffling, or diminishing the report of a portable firearm, including any combination of parts, designed or redesigned, and intended for use in assembling or fabricating...

Re: Can you become an NFA dealer from your apartment?
First look at whether you could operate any type of business from that location (think zoning regs). Next look at whether you could operate a business that sells products directly to customers at that location (even if the customer traffic would be minimal). In some cases, this depends on whether yo...

Re: Judge Rules ATF "Jumped the Gun"
Take suppressors off the list, log them in at purchase as a firearm with the $200.00 'tax' , and save literally millions for citizens, ATF staff, and streamline fighting criminals as well as the FBI. That's not ATF's choice. It would required Congress amending the NFA statute (and the President's s...

So the matter has been remanded to the now-scorned ATF Tech Branch to evaluate it again, presumably using their "state of the art" sound measuring equipment. Since their "Standard Operating Procedures" do not include very detailed protocol for how their sound measuring equipment ...
