You have more powder space in a 38 Super and can load a heavier sptizer type bullet to max subsonic velocities. More energy at the target!
Or better yet, load a 357 Maximum!

Seems like it would be ok. The term “Rifle” means a weapon designed or redesigned, made or remade, and intended to be fired from the shoulder and designed or redesigned and made or remade to use the energy of the explosive in a fixed metallic cartridge to fire only a single projectile through a rifled bore for each single pull of the trigger.
The term “Shotgun” means a weapon designed or redesigned, made or remade, and intended to be fired from the shoulder, and designed or redesigned and made or remade to use the energy of the explosive in a fixed shotgun shell to fire through a smooth bore either a number of ball shot or a single projectile for each single pull of the trigger.
So once a shotgun has been redesigned, remade, and intended to fire...through a rifled bore... (rifle definition) it should then be considered a rifle.

Bingo. You would have to permanently alter the "shotgun" into a "rifle" by removing or disabling the smooth bore barrel.
Also the thompson center guns have interchangeable rifle/shotgun barrels so there is a working example.
