Changing caliber of an approxed Form 1 tax stamp

Yes, it can be legal to make a silencer. For everything Form-1, from silencer designs that are easily made, to filing forms with the BATF, to 3D modeling. Remember, you must have an approved BATF Form-1 to make a silencer. All NFA laws apply.

I have a stamp for a Form 1 I did a year or so ago but haven't made yet. I have changed my mind on what caliber I want. Is there a process with the BATF for changing the caliber?

"5. Cancellation of Approved Application.
An approved application may be cancelled only if the firearms had not been made or modified. The maker must return the approved application with a written request for cancellation, citing the need and that the making of the firearm did not take place. The NFA Branch will arrange for a refund of any tax paid."


you could cancel, get a refund, and reapply. There might be an easier and faster way, im not sure.

What caliber and length is the original stamp approved for?

My stamp is for 9mm. I don't remember the length offhand and I'm travelling so I can't look at it, but I believe 9". I seem to remember using a fairly long length on the Form 1 so I could choose a shorter length later. I've decided I'd rather do a 300BLK. I know the bore diameters are close enough that I could make one and engrave it 9mm and use it on 300BLK if this were a threaded suppressor but I'd really like to use a short barrel and pin/weld it to the barrel so I don't need a separate SBR stamp. I don't feel good about engraving 9mm (per the Form 1) then permanently affixing it to a 300BLK barrel. That's why I'd prefer to change the caliber on the stamp.

9mm is .355" so make your baffle bores ~.355" and engrave w 9mm. Absolutely NO problem. Even permanently affixed.

Your other option would be to request a "correction" from ATF. There's an Agent that people here use for their willingness to help. I don't remember his/their name. But you should contact an Individual rather than the entire Agency. That way a specific person is accountable, rather than an faceless beauracracy.
