Form 1 Maker when is it officially made?

Yes, it can be legal to make a silencer. For everything Form-1, from silencer designs that are easily made, to filing forms with the BATF, to 3D modeling. Remember, you must have an approved BATF Form-1 to make a silencer. All NFA laws apply.

Form 1 Maker when is it officially made?

Post by Blk_n_gold »

Guys,
I am looking for some clarification.
I am doing my first form 1 build.
Based on what I have read from the ATF, an individual with out a FFL and SOT cannot repair a silencer.
With a Form 1. When does the making stop and the “ it’s made” start? What happens if I buy an extra part to verify my limit machining skills. I know that once I am done make my silencer I need to destroy said part.
How long do I have to complete my build?

Thanks in advance.

There's no time limit for completion.

Can I test my design while building?
Or should I have 2 stamps one built and one always being built?

I had a long reply for you, all typed out, and the site ate it. You get the amended version.

What you're asking/thinking about would be illegal. It's a silencer when it meets the definition, not when you say so. A Form1 maker can legally repair their own silencer/property, regardless of original maker/mfr. Repair doesn't include replacement parts, that's something entirely different and requires approval or a license. No time limit on making, but there could be legal ramifications (but, highly doubtful).

You'll benefit from doing more research on silencer design and theory. This site has almost 2 decades worth of threads. NFATalk is another good site. READ and your time will be reflected in the design.

Thanks for the response.

Here is my planned design.
Stainless Steel 17-4 60 deg cone cups. 7 of them.
A single clip depth of .190-.220
Width of 060"-.070" on a blast baffle
and .040"-.045" for the rest.
Tube length inside is approximately 6.4
This in what I have read should be a good design. This is other people’s brain power.
This is for a 308 win super sonic.

Any thoughts or recommendations would be appreciated.

Well, sort of.

Technically, it's a silencer as soon as you bore the end cap and assemble that onto the tube. But that doesn't mean it's illegal for the F1 maker to manufacture the rest of the parts.

The real answer to the question is, it's done when it's done, which means not engaging in intellectual dishonesty and trying to use "it's not finished" as some kind of loophole to add or replace parts down the road on a silencer which you darn well know was fully built.

I have came to the conclusion over the years from reading this so many times; every time I hear someone is ask this question, is because they want to do something that they know they shouldn't be doing and are looking for ways around the law and loop holes.

There are no loop holes in this.
I don't care what your chart says

Exactly, a tube with a bored cap would meet the definition. I didn't say it would be illegal to make the rest of the parts. It would be illegal to go the route he was alluding.

My longer reply, which was lost, was more lucid and extensive. I took a mulligan on the second shot ;)

You're buying parts or you're machining parts? Regardless, if you tear something up while making, scrap that piece and carry on. You complete the whole thing and decide it doesn't perform like you think it should, you could clip baffles, cut down some spacers and add a new baffle, or similar. You can't scrap the core, and just redesign/rebuild from scratch. You can't say "I should have made the whole diameter 1/2" larger" & start over.

What you do in the privacy of your own garage is your business, but blasting "What-ifs" on the interwebs ahead of time documents your intent......
