SOUTH CHARLESTON, W.Va. (WSAZ) -- As if getting a DUI wasn’t enough, a man arrested for driving under the influence got in a lot more trouble at the police station.
Police stopped Jose Cruz on Route 60 in South Charleston Monday night for driving with his headlights off.
Then, he failed sobriety tests and was arrested.
When police were trying to get fingerprints, police say Cruz moved closer to the officer and passed gas on him. The investigating officer remarked in the criminal complaint that the odor was very strong.
Cruz is now charged with battery on a police officer, as well as DUI and obstruction.

Isn't assault when you put someone in "fear of immediate physical harm"? This could be standing way too close, or a spoken verbal threat, or even cocking a fist back.
As I recall, even telling someone, "I'm going to hit you three weeks from now" does not constitute assault since it isn't "immediate". In order for this to pass the smell test (YES! - HORRIBLE PUN!) the cop would have state for the record that the fart put him into fear of immediate physical harm. I don't see how that is possible. Even if the fart was abnormally foul.
I read that it's douche to list your guns here, so I stopped that.
Yeah, my local news channel just made Drudgereport again. We did this earlier with the duct-tape bandit. The place he robbed is less than a mile from me, and of course I have to give them s--t everytime I step foot in their establishment.
While we're at it, lets charge people for having breath that offends a cop, or for not using the right soap or 'body wash'. Any time the justice system fails like this they should just let the guy walk. Hell, they let OJ walk.
