Anyone else watch this show on The Discovery Channel? Decent show but if it's illegal to make moonshine then how is Tim not incriminating himself for not only making moonshine but tax evasion? Just curious.

I believe people are allowed to make some within a limited quantity, and without selling it.
The thing that pisses me off about that is, how is it acceptable to make some, but make beyond some arbitrary amount, and its illegal? Its either immoral/unethical or it isn't.

The show isn't portraying anything illegal because of the amount they are making.

Acutally, believe that it is illegal to have a still and to make any amount of alcohol.

In my state 5 bucks get you a permit to make 300 gallons for personnel consumption and 3000 for vehicle use.

Not "unless you get a permit from your state", not "under this amount is okay", distilling spirits (plain ethanol, that hasn't been tainted for fuel, and is intended to be consumed) is 100% illegal in any way, shape, or form unless you are a Federally recognized distillery.You cannot produce spirits for beverage purposes without paying taxes and without prior approval of paperwork to operate a distilled spirits plant. [See 26 U.S.C. 5601 & 5602 for some of the criminal penalties.]

I misunderstood that they were making "hard" alcohol. I know that people make wine at home all the time.
My original question stands; how is it morally/ethically acceptable to make wine at home, but it somehow falls under government jurisdiction the instant the proof exceeds some completely arbitrary amount. It is either wrong, or it isn't.
I feel the same way about rape. I rape women once a month, but I know that if I move up to 15 per year, that this will be looked at by the government unfavorably as immoral.
I use three ounces of marajuana every weekend because it makes me feel good. The government doesn't mind. But if I move up to a full kilogram of possession, then that means I have "intent to distribute", meaning... when I use it alone, that's OK, but if anyone else use's it alone, that's naughty.
<insert bullshit here> to some <insert arbitrary number> extent. And that is OK. But when I <repeat bullshit here> a the rate of <insert previous arbitrary number * 1.4> it is not OK. Because sin is acceptable is slightly smaller doses.
I wonder if we could extend that to law-makers in general. Could I get away with issuing prescription-strength 'dirt-nap' pellets to the people who think this way if I only did a few? What number becomes unacceptable?
