Re: Florida woman given 20 years
She wasn't being assaulted or in imminent danger. She left went into the garage and returned with the gun, firing a "warning shot" as she entered the room where her SO AND 2 sons were located.
She fired it into a wall.. She was escalating the situation as much as anything else, and was charged. She was offered 3 years and her lawyers figured they could stretch the SYG and Castle Doctrine laws to suit their defense..
Neither the judge nor jury took the bait. and they found her guilty. This is as far from a SYG case as it gets..

20 years for firing a shot though? This guy admitted that he was going to "put his hands" on her and beats all his "baby mama's" with the exception of 1 of them. The only thing she did wrong was not shoot him and hit the wall imo.

Re: Florida woman given 20 years
That is an accurate summation, but the problem is the mandatory sentencing did not give the judge the ability to lower it.
Three years seems like a lot also.

Re: Florida woman given 20 years
Three days would be too long for someone going through blatant abuse. Wonder what's going to happen to her idiot bf. Just goes to show that if you're in a bad relationship, get the hell out BEFORE it gets to this point.silencertalk wrote:That is an accurate summation, but the problem is the mandatory sentencing did not give the judge the ability to lower it.

Re: Florida woman given 20 years
Yeah the actual assult/domestic issue is not the root of the 20 year sentance, its firing a weapon during the underlying situation.
There's apparently a 20 year mandatory sentancing requirement for firing a gun during a crime.. Thats what had the teeth.. and what her lawyers should have realized wasn't nullified by SYG or Castle Doctrine. A warning shot is not a defensive shot.. When you are in fear for your life, you shoot to kill, not to warn or injure. She obviously didn't demonstrate toa jury or the judge that her actions were consistent with those conditions..
They may have demonstrated that the garage door was not broken, that she deliberately took the route through the house that was unneccessary.. The papers are not concerned with the REAL details, they just want a blurb, to make SYG/castle Doctrine appear to be ambiguous.. It doesn't apply in the way they were trying to apply it, but it CERTAINLY benefits people opposed to the laws, as they can point to it as being selectively applied, or as the defense of crazy people who like to "shoot first and ask later". In either scenario, they win.
20 years is harsh, she should have taken the 3 year offer. I'd bet that she'll appeal based on bad guidance from her ineffective lawyers, etc, etc....

.... at least she knows she wont get beaten by him for the next 20 years
but yeah, we have that 10, 20, life (if I remember correctly) rule here in FL. 10yrs if you use a gun in a crime, 20yrs if you fire it, Life if you kill someone (might be shoot someone, but that seems like much). Pretty sure they are all mandatory sentences as well.

Bitch deserves 20 for trying to stretch good laws to cover her foolishness and playing the victim card when it was plain she was in no danger.

Nothing wrong with using what you feel is the best legal argument. And taxpayers have to pay like a million dollars to house her now.

I think she was in danger of getting her ass whooped again. She should've shot him and not the wall

I just love the unbiased media...
