Ripped off by SOT/FFL?'s

I E-File'd 'form 4' for my GemTech Outback 2d Desert digi-camo on 4/25/13, at Davidson's Firearms on Eastern in Henderson NV. I gave him my $200 cash (for the Tax Stamp) at the 4/25/13 filling. I refilled 2 or 3 times since, going to his shop and signing new papers.
Most recently, not finding satisfaction, I had him do a form 3 transfer to another local shop to do the form 4 right. He told me that he did the form 3 last month.

The reason for my mutiple attempts of getting him to do it right, is that after 1 month+, of the dealer saying it was done, I called the NFA Branch & they said every time, that there has never been a record of anything from my cans serial numbers, or anything going to me, or my trust, or anything going to my Socail Security Number.

I'm out the can I ordered to him, & my $200 cash for the tax stamp.

Now, he doesn't return my emails now.


What can I do.
An ATF complaint? The NFA Branch complaint?
BBB & Yelp?

A Law Suit is my last resort.

I know you said lawsuit was your last resort... but I think you may just have to stop playing games with him and take him to small claims court

I'm not too sure what you're waiting on anymore.
He clearly is avoiding you and the situation.
It's been 31 months since the first e-file.
I would have gotten the Sheriff or the ATF involved at 12 months, taking into account product availability at time of purchase.

How did you pay for the suppressor? Cash, Check, MO, CC?
If by CC then see if you can dispute with CC company.
If you haven't paid for the suppressor, but only the Tax Stamp, I would say it's a $200 mistake. Move on

If he has ALL of your money, then you should get all your paperwork in-hand and go file in small claims.

Your in a crappy situation, I won't dispute this, but you should have taken action LONG ago.

Do you have evidence of the payment for the tax or the suppressor.
Recites for cash, credit card charges a paid invoice with your name attached.

Send him a set of bull ball's for Xmas as a reminder of your transaction.

I bought the can from GBroker.

I paid cash for my tax stamp.

After 5 called to him in 2 days, the dealer today, offered me $150 for my can, or to sell it on consignment, or to Re Fax the from 3.

I said I'm going down there tomorrow, to have cash, a check, or M.O. ready, for my refund of $200 that I paid for the tax stamp.

I told him to resubmit the from 3 to another shop.
Ihave decided, if it ever gets to New Frontier Armory, I want to donate the can to Wounded Warriors Project. To make some good, out of this very negative situation.

What a nightmare. I went threw a fiasco on my first couple can purchases but nothing like this. I am so thankful I found the dealer I now use (THSF). It makes buying NFA stuff SO easy!! After all the hounding you went through the guy can't even get a proper form 3 submitted. That's ridiculous!!

NFA stuff is downright scary. Many of these small local dealers are undercapitalized. They have your NFA item for months. If they go out of business you have to try and track down you product. At best, it is at another dealer who can complete your paperwork when the stamp is approved. This happened to me. I found my cans in another city and had to pony up a bit more cash in handling fees. I won't buy over one can at a time.

Please don't. They have become anti gun and not enough of the donations go the the actual Wounded Warriors.

He can't donate it as they will not accept the firearm. They also will not accept the cash from the sale of the firearm if you tell them that is where the cash came from.

They are heavily anti-gun, as well as anti-alcohol.

The American legion,VFW & maybe the DAV would know where the money can best be used.I donate to the Purple Heart myself.If the laws permit why not raffle off the item and donate that money.You could raise much more than the face value that way.You may need a licensed sponsor to hold the item.I would gladly donate a prize for a honest event that would help a brother or sister.I would also donate time to find sponsors or what ever.I bet you would get a huge amount of support from the many members on these pages alone.If the law allows it who knows this could spiral out to be a wonderful thing from a crappy deal.
