I F'ed up

When I submitted my form 1 for an sbr, I put 22" overall length and should have put 24". How much trouble will this potentially cause?

You will be hunted down by black helicopters and your dog will get shot, its bad!

Seriously though, its not a big deal, just send the ATF a letter amending the form to the correct information and you are good to go. SBR's are easy......silencers can be more difficult.

Does it matter if I efiled it? I'll look for options to contact them. I just submitted it yesterday, so I hope I can get it amended before it goes too far.

What B said is correct, but I would do this:

Contact [email protected] and let them know you wish to withdraw the efiled form 1.
Just refile, tonight, with the correct info.
It will be quicker than waiting for a response to verify the correct info yadda yadda.

Good point, cancel your current one, then file a new one. You will have the $200 tied up till they refund you but it will be alot faster than trying to amend.

I just got off the horn with NFA and they said to just let the application go thru to approval and then I can send them a letter with the correct length. Thanks for getting me headed in the right direction.

This is the response I received to my email before the phone conversation.

Annotate the RECORD w/ the information you provided, reference Overall Length: “should be 24"

Can anyone help me decipher that. Does it mean I need to annotate the change or that he did? I take it that I'm supposed to annotate the change, but I'm not sure where to find the RECORD. I understand that I need to measure the proposed rifle WITH the muzzle device and the stock fully extended, correct? Any guidance with this is greatly appreciated. Thanks.

No need to overthink it, The email is just saying to send them a letter after approval. They just used bureaucrat talk to say it.

If he adds an aftermarket buttpad, will he need to further ammend his approved form to add the length? Is it only needed if adding 2"+?

I have filled out 2 Form 1's in the past and have always left that field blank.
My forms were done in the mid 90s if that matters.
How would I have known unless I have already built the firearm to measure it?

I wouldnt sweat it, I called and asked how the hell can I do that without having built the rifle, they told me to estimate it with the info I had available. Really dont think it matters.

I have been told by the ATF that the length is not a critical specification and that even if my length did not match my approved form I would be fine.

Notifying the ATF of changes after it is approved is recommended but not required by law. If I decide to change calibers there is no legal requirement to notify them. On one of my submissions I screwed up the length and contacted them. The agent said as long as you had an approved form with a serial number that matches you are fine.

Personally I would not cancel anything because there is not legal reason why you should.
