Moving with NFA items

Post by mbogo »

My trust owns NFA items; if the trustees move to a different state (where NFA items are legal to possess):

1) does the trust have to be amended in any way?
2) do the Form 1s and Form 4s have to be amended?

I know the BATFE has to be notified of the move and has to send me "clearance" to move the items out of state; just wondering what else would be involved.

my trust has a a separate schedule attached with the address of the trust. I can destroy and reprint that page without notorization.

From what I hear, not all trusts have addresses listed.

The form 1s and 4s don't need to be updated. The address on a form 1 is where the nfa item is being manufactured. Obviously on a form 1 the location of manufacture hasn't changed after you've moved.

The trust was executed in my current state of residence and says as much in the first paragraph.

The Form 1 lists the "Applicant's Name and Making Address", which is in my current state of residence.

Form 4 lists the "Transferee's Name and Address", which is in my current state of residence.

That information would be out of date if I move to another state, hence my questions.

I did a change of address a couple of months ago and used atf form 5320.20. All of my nfa items are on form 4 individual.

Anything about changing the addresses on the Form 4s?

The form 4's address remained the same. The new address is shown on the atf form 5320.20. I assume if you were to sell a nfa item you would use a copy of your form 4 along with the form 5320.20. Again my are on form 4 individual.

Federally speaking you fill out the .20 for the move, marking it a perm move to the new location.

Once you get it back approved, that's it.

There may be other local issues at the state level etc.

As far as the trust, you would need to make sure the trust will still be valid in the state you are moving to. For most it's not an issue, but only a good lawyer with knowledge of the local trust laws could tell you for sure.

It would truly suck if my NV trust was invalid in TX. :(
