AOW ownership

Post by saemetric »

How does a person register an AOW that is in his possession via gift from a now deceased person that to his knowledge has never been registered previously.

AOW in question is an Ithaca M6 o/u 410/22 hornet survival type weapon with 14" bbls.

Is it possible?

The simple answer is you can't. Fed's will tell you that it's contraband and illegal if it's never been registered and is in nfa form.

Though, if it were me and was important to me, I'd probably register it on a form 1 myself while removing the barrel(s) and storing the receiver and barrel(s) at different locations until you got the nfa approval signature.

You may could register it yourself or throw away the short barrel(s) and I assume the stock if it has been cut into a pistol grip and just buy replacements that are 18" or longer and restore it back to title 1 form if you'd rather go that way.

It will cost you $200 and about a year of waiting if you go NFA route.

I just hate to see good guns with family sentimental value be destroyed. Especially since it was no fault of your own what a previous owner did to it.

But to answer your question, an unregistered short barrel rifle or shotgun or aow is a felony to be in possession of.
I don't care what your chart says

Some info I could find

If you have a trustworthy 07/02 in your area, I would consult some advice. May be valuable enough to get a lawyer involved as well to see if it's registered.

I have a class 3 dealer friend that is friends with "his" ATF agent. He has in the past asked the ATF guy to check for registration paperwork on machine guns found in the attic of an old woman's home.
In this case he was able to find that the pieces were registered and had copied of the paperwork so in the end the guns didn't have to be "parts kit-ed" and were fully transferable.

This may be an option for you.
