Congress votes to repeal Social Security gun control regs--signed 3/01

Post by johndoe3 »

https://www.nraila.org/articles/2017012 ... y-gun-grab

The NRA/ILA is happy that their strong push on Congress to overturn the Obama Social Security gun-control regs will get a vote to repeal it next week. This gun grab using Social Security by Obama had Social Security people trick people into giving up their 2nd Amendment rights if they were tricked into signing up for an alternate financial representative payee as a contingency. If tricked into it, a Social Security recipient is deemed mentally incompetent and added to the NICS database to prevent them ever buying a gun (or getting a CCW, etc.), WITHOUT any due process to fight it.
The NRA immediately opposed the Obama administration's efforts when the proposal was first announced in summer of 2015. The NRA has fought every step of the way to ensure that social security recipients are not stripped of their rights without due process of law.

Congress is now going to review the Obama administration's unconstitutional ban under the Congressional Review Act (CRA). CRA allows Congress to dispose of any actions an outgoing administration initiates in its last six months. This final rule falls under that time frame, and the review process is expected to move forward in the House and receive a vote as early as next week.

"We are pleased that Congress is moving swiftly to ensure that law-abiding Americans' constitutional rights are respected," concluded Cox. “We would like to thank Reps. Sam Johnson (R-TX) and Ralph Abraham (R-LA) for leading this effort in the House, as well as with Speaker Paul Ryan for his leadership on this issue.”

Must be a relief now that Obama has left office and is no longer the Commander in Chief, that active duty military folks can now call him names while having a clear conscience about not violating regs.

OBTW, the House voted Thursday on repealing the anti-gun Social Security regulations, and the repeal passed 235-180. Now on to the Senate along with all the other regulations the House has passed for repeal this week. Let's hope the Senate R's don't go wobbly on us, because they'll likely get no repeal votes from the D's.

Today, the Senate voted 57-43 to eliminate the onerous Obama anti-gun regulations in the Social Security Administration. The House had previously passed it 235-180. On to the president, and Trump will relish signing this Bill.

Even a small number of Dems in the Senate recognized that the Social Security regs stripping the 2nd amendment rights of people is extremely bad law.

We can hope that Congress does the same thing to the similar set of regulations in the Veterans Administration, which has reportedly stripped between 150,000 to 250,000 vets of their RKBA by trickery (if you sign up for a financial payee to assist you, then we will give you a little more money per month, and then without the vet knowing it, their name is submitted to the prohibited NICS list forever with no due process).

If this was purely about altruism and public safety from people living on the public dime, then how about opening welfare recipient records to police departments? This is all kinds of bad law, but if the "Social Security gun control regs" above is done "for purposes of good", then why not the other? It makes so little sense to fund somebody's illegal flight from the law.

Just checked and HR367 has 100 co-sponsors, and the companion senate bill S59 has 7 co-sponsors.

HR367 has been assigned to the Ways and Means committee and Judiciary committee.

S59 has been assigned to the Finance committee.

They are going through the normal sausage-making process for Bills, and have to pass the committees first before getting a vote.

The President signed the Bill today (3/01) revoking the draconian Obama Social Security regulations which sought to ensnare SS recipients as mental incompetents if they were tricked into signing up for a alternate financial payee, and thus losing their gun rights for life (with no Due Process).

Great job by the Congress and President to strike down one of Obama's last minute gun grabs as he was leaving office.

Why is this a big deal? because the Ways and Means committee had estimated that 75,000 Social Security recipients would have had their RKBA taken away per year.
