Trust question?

General silencer discussion. If you want to talk about a specific silenced rifle or pistol, it is best to do that in the rifle or pistol section for that brand.

All NFA laws apply.

Trust question?

Post by Smokecloud »

I am considering putting a trust together for future suppressor purchases after doing a couple the regular route. I want to set up a trust so that the suppressors I buy now, can be used by my children when they are old enough and of course my wife now. Is it legal to purchase a suppressor on a trust with a child on it, or would I be shut down trying to put a suppressor on a trust with children? They,of course would not touch the items until they were old enough. Or can I add them to the trust when they are of age?

The answer to your question is going to depend on what capacity you list the child in the trust and whether or not it is an "adult child".

They are both very young minors at this point, but since these purchases seem to be for life, I was just trying to plan accordingly.

You can word the trust to say they will only get possession after they age of 18. I recommend talking to a lawyer or someone who is well versed with writing trusts.

The kids need to be 21 before they can take possession of an NFA item.

This. I built a silencer at 20.

Hmm.... Everything I've ever read says you need to be 21. Does that only hold if you are purchasing from a class III dealer? (homemade and inherited items being exempted?)

The crocus here is that there is a legal distinction between what your NFA (Class 3 is a TAX BRACKET) dealer tells you and what your dealer doesen't tell you.

If someone comes to me - AS AN FFL I am obligated to tell them they need to be 21 to buy an NFA item.
If someone who is over 18 wishes to buy via Form 4 / build via Form 1 PRIVATE SALE an NFA item, that is 100% legal on a federal level. Save for a Form 1 MG.

To understand the law is to understand that there are different standards to which people are held. Just because a dealer says it - does not make it so 100% of the time.

I revised my post, lest another person decides to Form 1 a machinegun at 18 since there's already plenty of documentation on that thread.
