Suppressor transfer to Trust? New info from my examiner

So, today I FINALLY was able to pick up my NANO from my dealer. After I pick up my paperwork and the suppressor, I head straight to Office Max to get some copies of my signed/stamped Form 4. I pull it out of it's envelope and tell the lady that I'll need both sides. It is at that point, I flipped it over to show her "both sides", and realized that my stamped/signed Form 4 did not in-fact have a back side! Apparently my dealer or I sent off (incorrectly, mind you) a Form 4 as TWO sheets (front & back) instead of ONE sheet (front/back), which is usually a no-no, right? Typically grounds for rejection and costing some more time.

Well, get this. I call my dealer and he's unsure of what to do, so I call the ATF. I get a nice receptionist lady (one of the ones who checks the statuses of our devices) and explain to her what's going on. She says this should never have been approved and that she's send me through to my examiner, Dana Pickles. I leave a message on Mr. Pickles' voicemail and get a return phone call within 30 minutes. Mr. Pickles explains to me that he was able to approve my Form 4 for this very specific reason: I was transferring a SUPPRESSOR to a TRUST. Had I been transferring anything other than a suppressor (any other NFA device) to anything other than a Trust, I would have had to redo my Form 4. However, because I met the requirements above, there is no actual need for me to fill out the back of the Form 4 when transferring a suppressor to a trust because, 1.) the suppressor isn't a firearm (not my words, his), and 2.) the Trust isn't a "person" that can have committed a felony (or any other of the check-boxes we need to fill out).

This was news to me, but he assured me that I'm good to go with JUST the signed/stamped front page of the Form 4. Anybody else had something like this happen?

I think this is a rare example of someone in the government using their head. I wouldn't recommend anyone follow this as SOP, but it's comforting to see it happen for you.

so you had your suppressor as an individual form 4 with pics and fingerprints and then you sent it a new form 4 to have it switched to your trust and this went through? I am thinking of doing my individuals to a trust and this is a great thing...

No no no no. I was always transferring to my trust. I don't do individual transfers.

Dana Pickles is a very efficient and good examiner. if you look at his average turn around times, they typically lead the pack.

also, your dealer needs a duplex printer. even a $100 b&w laser printer that can duplex will solve this issue. i don't think this issue should have come up in the first place. let's face it, the mark up on suppressors is pretty high. so invest in a nice printer and write it off, capitalize it, whatever.

but glad there was a "loop hole" that worked out for you. i would rather had like to have the opportunity to re-submit it before it was approved.

Yeah pat someone on the back for doing there job. In gov't that equals a promotion for Dana and then where will you be? Back to long waits.

It's my understanding it will cost you another $200 (or $5) per transfer. May not be practical for some items. :?:

Me too. I've actually read that over on MDshooters.com in a LONG thread on trust transfers. Any transfer of an NFA item from someone to the trust, or out of the trust TO someone will incur the $200 tax.

Last I heard a suppressor ,according to the NFA handbook, is considered a firearm.

We can always just go with the fact that the ATF just pulls things out of their ass. What probably happened is Mr. Pickles didn't have his morning coffee yet, still had 'sleepies' in his eyes and screwed up. It worked out for you just fine, but I doubt that what he told you would happen successfully again. With the kind of wait times we have, does someone REALLY want to volunteer to find out?

....yeah yeah....and a suppressor is really a silencer and also a firearm. yada yada....apple and orange argument that resurfaces periodically
