Let me answer your first question before I get to the other two...

You might have to check with each state's game commission. For example, in PA, the PGC responds with letters that there is no law against it, therefore it is legal, to anyone who asks them about it.

Were you looking for a particular state or states?

I believe it can also vary by county within your state.

I wrote an email to the UT Div. of Wildlife Resources 8 or 10 years ago asking that question. I also asked if it was legal to hunt small game with a machine gun (jackrabbits and other rodents  ) The response was that both are legal. They seemed more concerned that the NFA stuff was properly registered with ATF.

Of course that email is long gone (I've looked). I keep thinking I need to send in a letter and get a response on official letterhead. You know - something to keep with me next time I'm out on the desert helping the local farmers with their rodent problems. 8)

With regards to Kansas, I searched the internet and most people said NO but nobody could point to any specific laws/statutes. I also searched the KS State Statues and never found anything related to silencers/suppressors. I thought that maybe I was misusing the search function or not looking in the right places, though.

Here are the KS statutes:

Nothing to be found with regards to silencers or suppressors so I emailed the Kansas Department of Wildlife and Parks. Here is their reply:
Silencers/Suppressors are not allowed for hunting in KS. No specific statute prohibits suppressors but they are not included in our legal equipment for any species.

This reply troubles me, however; I always thought that the interpretation of "law" was that something is legal unless it is deemed illegal (not the other way around). In other words, it's not illegal unless the law says it is. Since KS law says nothing about hunting with a silencer I would have assumed it was a legal act. Even if I had the law printed out in-hand if I got stopped by a game warden it wouldn't do any good since they interpret the law "backwards."

I don't have the funds, though, to be a "test case" of the constitutionality of the law but I thought I'd let everyone know my findings.

The catch with PA thus far is that you can't hunt with a semi auto, thus far at any rate.

Texas , it is perfectly legal as long as you are not hunting game animals.

Legal in Alaska. Can't use machine guns.
