Hello, my father just passed and I'll be heading from WA to WI. I am named on the trust for two suppressors. I'd like to get the legalities taken care of, and possibly send them to myself.
I know this info is out there, but at this moment I'm a bit preoccupied:/
Any links or info would be exceptionally appreciated.

What is your position in the Trust? Co-Trustee, Successor Trustee, Beneficiary ? this makes a difference.
Re: Please help answer a trust/transfer question
I actually just arrived home last night. I found the stamps, background check, but not the trust yet. I will find this out ASAP.
Depending on which trust, is it possible to aquire these without going through the background process? I understand that I won't have to pay the $200 again.
My mother was saying that my father said I wouldn't have to go through all that he did. Not that she understood or that that means anything..
Thank you for your help guys. This is all very overwhelming.

You will submit a Form5. You are still required to go through the background check....they wouldn't give a criminal possession just because they were an heir.2ac wrote:I actually just arrived home last night. I found the stamps, background check, but not the trust yet. I will find this out ASAP.

Re: Please help answer a trust/transfer question
See what the trust says about termination, specifically in the event of the grantor's death. I've seen trusts that were multi-generational- Grandpa was the grantor and co-trustee, along with Dad and Son also being co-trustees. Once Grandpa dies, the trust can no longer be changed/ amended. Dad and Son are still co-trustees, but the terms of the trust say it doesn't terminate until Dad dies. Once Dad dies, Son needs to get the Form 5 process going. A Trust can "exist" in most states for a " life in being" plus 21 years. In the example below, the Trust that Grandpa had done could remain valid for Son's life plus an additional 21 years, if Son is alive at the time Grandpa had the trust organized.2ac wrote:I actually just arrived home last night. Bottom line- find the trust and see what it says.

Re: Please help answer a trust/transfer question
This is a good learning moment regarding best practices for those of us not yet in this position: keep the trust(s) with the original stamp forms and purchase receipts in the same envelope, and have that envelope in a fire safe or regular safe / bank deposit box.
I can't think of any reason to not have everything together, in a safe place, and in a plainly marked manila envelope.
