Obama's last anti-gun push, UN Arms Trade Treaty

Post by johndoe3 »

The UN Arms Trade Treaty(ATT) was formulated in the UN with much direction by the Obama administration to overturn much of the 2nd amendment, state gun laws and the US courts by a Treaty.

This week, Obama submitted the UN ATT to the Senate for ratification, even though John Kerry signed it for the USA in April 2013. The reason it was never submitted previously, was that at the time in 2013, a bipartisan group of over 50 senators sent Obama a letter saying to not bother submitting the ATT because it would never be ratified (requires 2/3 of the senate for ratification).

This lame duck submission by Obama is a last 'hail mary' attempt for gun-control as he goes out the door.

What would this treaty affect?

I hereby solemnly swear to obey any future gun laws as much as I obeyed the assault weapon ban.
The moments I was censored was the moment that I won. That's twice, now. Thanks jwbaker, et al, for my victories.

I remember the uproar about this and the UN coming to take everyone's guns. If you take the time to read it it has no authority to influence laws within the US. I know we need to be vigilant to make sure we keep the rights we have but I'm getting tired of fear mongering that has been driving the gun and ammo markets out of control

To the best if my recollection, there is a Supreme Court ruling, decades ago, that pretty much says that NO treaty may abrogate any right granted by the constitution.

Not sure if this treaty could do anything to our rights per se, probably not actually. But I think I remember that it would limit importation and exportation of arms and ammunition, thus limiting our supply and choices.

I wonder if the Dems are planning senate shenanigans regarding the UN Arms Trade Treaty while most of the senators are out of town during the Christmas-New Years holiday period? The senate is still in pro-forma session (every couple of days 2 senators are there to call the Senate in session and say no business present and adjourn).

In Article II Section 2 of the Constitution it says about the powers of the President:
He shall have Power, by and with the Advice and consent of the Senate, to make Treaties, provided two thirds the Senators present concur;...

Nothing in the Constitution requires consent of 2/3rds of all senators to ratify a treaty, merely 2/3rds of the senators present.

I was just wondering if the Dems were going to slip back into D.C. for a pro-forma session and call up ratification of the ATT and pass it under the cover of subterfuge? (They did pass Obamacare on Christmas Eve in the senate after the election gave control of the senate to the Republicans and before the new people were sworn in). I know the Dems are capable of all manner of subterfuge and will use any means possible, while the Republicans there don't have that aggressive will to win by any means possible.

The Constitution is "just a piece of paper".
