Yes, it can be legal to make a silencer. For everything Form-1, from silencer designs that are easily made, to filing forms with the BATF, to 3D modeling. Remember, you must have an approved BATF Form-1 to make a silencer. All NFA laws apply.

I don't see a problem until you make it something the seller didn't advertise it to be. After all, he may live in a less oppressive country where anything is possible.

The fact of the matter is that it won't matter what "ebay user: parisd20" or what "silencertalk user: mbogo" choose to call the item. The only relevant definitions at play are ebay's, the BATFE's, US Custom's, and the US State Department's. These parties are not known for their conservative or gun friendly definitions when it comes to restrictions.

The BATFE considers it a silencer.
It's against eBay's policy to post silencers for sale.

Also, flash hiders are covered under ITAR part 121 which makes it fall under eBay's domestic only sales policy. I can check, but I'd bet that silencers and silencer parts are covered under ITAR part 121 too.

He is advertising on ebay that the cover is "available with the purchase", effectively is advertising the sale of firearms on ebay even if he is not listing the completed firearm in its entirety.

This seems similar to listing a rifle stock and saying "barrel and receiver available with purchase".

It may not be an explicit violation but it's at least a snub at the rules.

This guy has been selling them for a loooong time, this is just the newest variation.

All are labeled as muzzle brakes, one he sold awhile ago was a full K baffle stack in a perforated tube, and he threw in the anodized tube that covered the perforated tube.

In regards to the ATF's interpretation of it it doesn't matter if its labeled as a muzzlebrake or a pound of sausage, it is still by USA standard a silencer component and can not be imported or sold for that matter IN THE US.

All about the intention of the part. The Oring at the base is pretty explicit on proving that there is supposed to be a tube around it even if the ATF didn't read the description.

I am aware of 2 that were sold to US persons and were subsequently turned over to the ATF upon realizing the implications.

looks nice at least The O-Ring is a dead give away that a tube is part of the device. Ebay usualy doesnt bother with stuff unless someone complaines

That design doesn't look to me to be very effective.
Would it work?
The air guns in the video are quite to begin with so i don't see his claim
to fame here. But hea i guess if he can peddle them somewhere, other than the U.S.
more power to him.

only thing I noticed with the suppressor on is a ping sound. As far as making the reduction in noise I didn't hear any difference in noise lvl. I noticed in the video tho he refers to the device as a silencer and on ebay he calls it a muzzle brake
