My wife is an ER Doctor. I asked her if she would take a 10 year old to the ER if they took 2 oz of a drink with Rum in it. She said no.
I asked if she would expect the waitress to be fired. She said no, because she did the right thing my reporting it.
I asked if she would sue, and she said no.
I think these parents were nuts.

They're just setting the ground work for the multi-million dollar law suit they're planning of bringing against Olive Garden.

I'm curious to know more details. The order receipt stated no alcohol. I've been to an OG before many times. The servers don't mix drinks, they deliver them. Bartenders make the drinks. I'm wondering if the waitress recorded the correct drink order for the child, which was forwarded to the bartender to mix, and the bartender made the mistake of making the drink with alcohol. Perhaps the waitress doubled checked with the bartender on that order after she served it to the table, then upon the bartender stating what was used to make the drink, the waitress realized a mistake had been made in the mixing of the drink (bartender's fault since the drink order didn't include alcohol).
If that's the case, it seems as though the bartender should have been reprimanded, not the waitress. Might be plausible, but there's more details we aren't getting.

If I were on the jury I would just toss it out. The lawsuits with judgements make the news because they are unusual. Most lawsuits don't win big judgements.jreinke wrote:They're just setting the ground work for the multi-million dollar law suit they're planning of bringing against Olive Garden.

Okay, we all know that a shot glass is a 2 oz. shot right? Does anyone in their right mind feel that's worth a hospital trip?

No. Only nutcase parents. If this happened to my kids, the police would not have been called. It would never be in the news. I am not sure I would even expect the meal to be free. A horrified waitress and an apology would suffice.

Same here. Plus, it sounds like the kid only finished half of the drink anyway.silencertalk wrote:No. Only nutcase parents. If this happened to my kids, the police would not have been called. they write
Tests revealed the boy did have alcohol in his system, but that it equaled less than 1 percent.
I dont know how it is for the US
But in Denmark the maximum you can have in your system and drive is 0,5 promille
1 percent is 10 promille
at 3 promille many will die
tough kid
or is fox news just ,,,

Probably it was less than 0.01 percent and the article was confused.
Re: Boy, 10, taken to the hospital after served rum at Olive
i think that this is a very bad news not only for the child but also to the fact that parents sometimes really have lapses of judgement that they forget how they should handle things especially when they themselves could not set a good example. poor child, i do hope he grows up to be a fine man and be able to keep his ideals even though his parents might not be much guidance to him

Remember the archeology professor that got kicked out of his house by CPS because he accidentally gave his son an alcoholic lemonade at a baseball game.

I would have been livid. I would not have called the police, gone to the ER or otherwise been a tool.

I would have had the kid finish it and watch the parents and wait staff fight it out.

Now I'm hungry for Olive Garden.
