Yes, it can be legal to make a silencer. For everything Form-1, from silencer designs that are easily made, to filing forms with the BATF, to 3D modeling. Remember, you must have an approved BATF Form-1 to make a silencer. All NFA laws apply.

As noted, I submitted my form 1 on oct 4, 2012. Is this the correct ph # to check on my status?

(304) 616-4500.


Is there another method, like online??

While that is the correct number, please know that calling really isn't going to do much for you this early in the waiting game. My last Form 4 didn't get approved until 7 months after pending almost to the day, and when I called to check around 6 months into the total wait I was told it took three months to go pending. One time, I called the day after a Form 1 was approved and the responding operator didn't have it on file that it was approved yet. If you're worried that your form was lost, you'd probably have to wait ~3 months; this is why checks are good so you know when payment was cashed.

Just checking, there was no answer for several tries.

I have heard rumors that approvals are happening faster if it's done "under" a trust, which mine was.

Mostly just wanted to confirm that is the correct number.

The rumor is correct, a Trust/LLC/Entity beats an individual form by about 2 weeks!

You have MONTHS to go, I would be surprised if your Form was even entered into the system by now.

There is no online searchable database either, its tax information.

Gonna guess that this is your first application right?

Feb-Mar if on a trust & coming back at same speed as mine have over the past few months.

You won't "hear something". You'll have to call if you want to know what status it's in. Otherwise will just show up one day in a plain envelope. Mine weren't like my C&R which was (a) much faster & (b) preceded by at least one letter that it was coming and what else to expect from ATF.

There is unfortunately no other way to do it other than the phone call. I did some stuff a few years ago to try to get an online query process (I even volunteered my time to do it!), but I got a brush-off letter from the ATF. My Senator sent back some crappy form letter rather than help at all.

If your check was cashed, you're most likely in the 'Pending' state, and that is what they'll tell you.

Anybody else have a "no answer" problem during normal business hours?

I know they're short staffed and all, but not answering the phones??

There are either 2 or 3 people that answer the phones for all of the customers, dealers, manufacturers and the .gov

If you don't get an answer try back later.
