Yes, it can be legal to make a silencer. For everything Form-1, from silencer designs that are easily made, to filing forms with the BATF, to 3D modeling. Remember, you must have an approved BATF Form-1 to make a silencer. All NFA laws apply.

when you form 1 a pistol can, do you measure from the back of the body of the silencer to the front cap or do you include the booster length as well?

can i err on the side of caution and list it as being shorter on the form 1 by half an inch?

If the "*booster" is not part of the suppressor then its not included in the length.

*A Nielsen device that attaches to the suppression tube forming the rear cap is a suppressor part and is part of its length.

*A Nielsen that screws into the rear cap of a suppressor is not a suppressor part and is not included in a suppressors registered length.
The only reason after 243 years the government now wants to disarm you is they intend to do something you would shoot them for!

With respect to filing a Form1 suppressor, to err on the side of caution would be to list a length LONGER than you're planning/thinking.
It is not legal to construct a suppressor longer than what is listed on the form.
It is best to plan, plan, plan, file, as to make sure your actual and listed length are near identical.

You can't just say "it's not a silencer part"...Make sure you design it so that it not the case.

90+% of the Form1 cans out there would classify as a silencer part.

Straight bore through the Nielsen device with no porting into the suppressor (other then the bore), and no porting into the Nielsen housing( don't allow the device to be an expansion chamber) ....and the suppressor should still be functional as a suppressor without the Nielsen device attached if you don't want it to be considered a suppressor part....that would be how I would approach it if you are set on it being removable. I am sure Bender or someone else will chime in if there is something I am missing.

Much more elegant ways to incorporate the Nielsen device into the design if it doesn't have to be removable.
