Good news for a change. Louisiana passed HB277 today without a single no vote on either side of the isle. This will go into effect Aug. 15, 2013. The new law eliminates any duplicate registration for NFA items. Any firearm, silencer, MG, and the like will no longer require state registration. The reason this got hot so fast was that the state forms were taking three months to get approved. This was before you could send your form 4 off the BATF. It was handled by the same division of the State police that handled concealed handgun permits. With the upswing in NFA sales the waits were getting ridiculous. Plus the state saw no revenue as the forms were free.

This is especially good news for out of state NFA owners that travel to LA with their toys. Before, you would have to register with the state first and then submit that form with the 5320.20 request to travel to LA. This was eliminated too.

My dealer and myself have been held up for months because of this stupid Louisiana NFA registration. This process use to only take 1 month in my past purchases. It wasn't bad until late last year, due to Shayna (the examiner) took leave and her replacement is an ABSOLUTE SLACKER!

Enough of my rant, and now my concern...followed by a question. My dealer has just received the signed LA form (originally submitted 1/27/13) to complete the BATFE Form 3 for my Specwar762. I had even decided to submit my LA transfer form on 4/2/13, since I knew my dealer's paperwork was months ahead of mine. Now that LA HB277 is about to get signed by the Governor, but doesn't go into affect until 8/15/13, I have a question:

Would there be any problem with me mailing off my Form 4 to the BATFE, in the first week of July, if my dealer has his Form 3 in hand? My thoughts are that the law will take affect 1.5 months after mailing my Form 4, and its been taking people 2-3 months for their paperwork to just go "Pending". Therefore, it doesn't seem like it would even be "examined" until many months after HB277 became law. It just seems that by the time I get my LA form, it will be worth nothing more than toilet paper.

Thoughts?

Nope us poor folks in Louisiana had a double registration process. Before if bought any item subject to the NFA out of state the out of state dealer would have to submit forms to the state of Louisiana before submitting the form 3 transfer. Than the in state dealer would have to do it again before you could submit the form 4. This added at minimum two months to all out of state transfers and 1 month for in state tranfers. Now with the latest gun rush we have a record number of peope getting concealed carry liscnese which the same people handled as the state registration amd took priority so the wait has been as long as 3 months lately for in state registration no including federal time added. So this helps hugely with dealers and residents alike selling or buying nfa in the state with wait times and paperwork.

Looks like the bill got its signature and is now ACT 398. It apparently goes into affect August 1st 2013, instead of the 15th.

Yep and the NFA Branch says if you sending a new form now it most likely wont be pending until after the law is in affect. So go ahead and send it but include a note with a copy of the new law explaining why their is no Louisiana registration paperwork included. :D
