In the surefire-AAC lawsuit, aren't the issues:
1. whether anyone looked at the two cans and ID'd the surefire can.
So how many people knew what a surefire bafflestack looked like?
2. whether the AAC can is really quieter than the surefire can
We all know that it is. Surefire cans are notorioulsy loud compared to other cans. Maybe relatively loud is a better description.
3. whether spot welds are stronger than circumferential welds.
I think we all know that a spot weld is not as strong.

Surefires are relatively loud. They don't pretend to be the quietest either. Their interest is in minimal POI shift. I don't find the noise of the M4FA to be objectionable.
Spot welds have proven themselves in military service over the past two decades. No one cared until someone started advertising fully welded cans.
AAC makes god cans. So does Surefire. I own a Surefire, but had an AAC ben available I might well have gotten one.

It is a copy of the OPS baffle stack. I am pretty certain that not many people alive could tell a difference between the two stacks. As far as the outside weld...we used to do it the exact same way SF is doing it now. Visual there is no difference.
Spot welding worked for the military for a number of years. We only invented our process after being involved in a military test where spot welding did not suffice. New, shorter barrel lengths and more demanding firing schedules have changed military needs...so, we developed better processes. It is not marketing, but it makes marketing easier.

Was it not the newer Surefire attachment method that was "INSPIRED" by the M4-2000/07?
Surefire is the most innovative company when it comes to their "Illumination Tools", but not so with their Suppressors.

I think those pics pretty much sum it up. BTW- 7.62mm versions are even closer to being a perfect match.
