This would constitute "making a new suppressor" and you would have to get a new tube with a new serial number and pay another $200. If they did it, then the ATFness falls on them.
Just to keep everything on the level:
You can absolutely shorten a silencer, for the purpose of repairs. This is from the ATF's mouth, not mine. Increasing length would mean making a new silencer, not reducing.

Appendix B of the Handbook:
Q3: May the outer tube of a registered silencer be repaired due to damage? If so, may the repair
be done by someone other than the original manufacturer?

A damaged outer tube may be repaired by any Federal firearms licensee qualified to perform
gunsmithing or by the registered owner. The repair may not alter the dimensions or caliber of the
silencer, except that the length of the outer tube may be reduced, as set forth above.
The repair may not be performed if it results in the removal, obliteration, or alteration of the serial number, as this would

I sit corrected! I guess if I had read my SOT and FFL manuals instead of getting opinions from three different NFA agents in DC who told me that I couldn't change the length at all I would not have responded wrongly. Thanks for the correction.

I still believe that AAC is wrong on the baffle issue. I can't find anything where they could not rebaffle or recore a suppressor.
Send it to someone else next time. I believe any SOT manufacturer can help do the job.

violate 18 U.S.C. § 922(k). In that case, the silencer may be returned to the registered owner in its
original, damaged condition or destroyed. A replacement silencer must be registered and transferred to
the registrant of the damaged silencer in the same manner as a new silencer, subject to the registration
and transfer procedures of the NFA and GCA.

I could be wrong, but AAC may have been holding out due to the liability of the lost baffle. Once found, it would constitute a spare part. Or, maybe they were just being dicks.

The same section I quoted states "any Federal firearms licensee qualified to perform gunsmithing". So, the OP had the option. I guess he was going for the warranty "freebie".

I know that ATF/NFA has an issue with spare parts and constructive intent, but I'm sure if he found the spare baffle and sent it to them for destruction that would be OK. They have told me that before, or to write a letter and include pics of the before and after of the destroyed part. I had a theoretical question for them once. I have a registered receiver MP5 made from a HK94 so it had the metal trigger pack housing. I wanted to buy a plastic SEF complete assembly but someone on one of the HK forums said that I would then have two sears and that is the part that NFA is concerned with? So I called them and asked if it would be an issue and they did indeed seem to have an issue with me having two sears. Now, I also have a registered receiver Bushmaster select fire AR and have been told I am allowed to buy all the spare M-16 fire control components and spare military type sears, pins and springs without a problem so I don't really understand why I can't have spare full auto grips for a registered receiver MP5. Anyone who has a semiauto HK can illegally buy the grips/trigger pack assemblies and a full auto bolt carrier and violate the law. Here I am, a fingerprinted and photographed guy with a FFL and a SOT 3 and I can't have spare parts for a 30+ year old firearm? I was told the easiest way was to throw away one of the two sears in the HK if I bought the trigger pack. Oh yeah, and now you don't get a spare wipe with your DA Ghost because a single piece of plastic might make you find some tubing, thread it, make a threaded screw on adapter with your barrel size hole in one end, build K baffles, make a threaded end cap with the right size hole..... it all seems kind of silly from the same people that basically allow unregistered SBR's by approving the Sig brace to be shouldered again .. at least this week, I haven't checked the regulations lately to see if all the guys at the range, including police and troopers are felons again... That's why I just use my license and have them on the registry. Guess I'll have to get my manufactures license next so if I want spare HK parts it won't be illegal. Wasn't there a show on TV years ago called "The Paper Chase"? Sounds familiar to some of the laws... like any of the cartels care...

Sorry to hear about your experience. But the person you are talking to is just being difficult. If you read my new post that I just posted. They had replaced a baffle stack for me in a silencer with a newer style baffle design. And to make them fit in the can, they had to add an EXTRA baffle to make it fit. Because the new baffles are shorter. Maybe try to contact Nick if he still works there. Or Cade. They have helped me with warranty claims in the past. Too bad Hollister doesn’t work for them. He made things happen :)
