In exchange, prosecutors dropped four felony indictments on charges that include misapplication of fiduciary property and tampering with a public document."

"During opening statements on Friday, Assistant Harris County District Attorney Bill Moore said Trevino used thousands of dollars donated to his charity -- Constable's Athletic Recreational and Education Events Inc. -- for his own personal use, including cashing checks for cash to play slot machines with his wife at a Louisiana casino and to buy Lotto tickets.

Moore also said the constable directed his bookkeeper to forge the signature of someone from the charity who is authorized to sign the checks. Then either the constable cashed the checks or sent deputies to do it at local convenience stores, the prosecutor said."

He took a plea that included him resigning and receiving a Full Retirement Package. No Prison time, no Jail time. (A Class C is a fine up to $500 ONLY.) Meanwhile, he has set up dozens if not 100s of his own Deputies; many of who have served either Jail or Prison Sentences; simply for refusing to commit the crimes which he and his Supervisory Ofrs ordered us to.

Why do you hate cops, Russian? This was a good cop doing a hard job, just wading through the nightmare. Sure, he made a mistake, but shouldn't we forgive that in light of his brave and selfless service? Plus, according to well established case law, he has less responsibilty for his legal actions than a demented five year old, so we should just let this go. Quit being such an angry person and an anticop bigot, Russian.

That is a shame.

I have found that when an employee steals it is often difficult to prove. When a manager or "higher-up" steals it is even more difficult. I have seen this many times..... and paid many "employee dishonesty" claims. In my experience.... rarely is there any real consequence for the thief. It is sad, but true.

Caught shoplifting, consequences.
Caught with someone else's property in your trunk or living room, consequences.
Steal a car, consequences.
Stealing cash from the drawer of a small business... rarely followed up on let alone prosecuted.
A "manager" running a business for the owner and stealing... difficult to prove and even more rare follow-up.... especially when most organizations have such poor internal controls.

..... and an effective thief is able to identify these opportunities and quickly learn how to exploit it. Reminds me of how people learn how to maximize entitlements.

Most often those involved, specifically those that suffered the financial loss.... want their insurance to pay then they want the
whole thing to just go away.

A few examples:
I knew of a case where a treasurer of a fire company stole money. It was provable... but when the fire department learned that if their insurance paid they would prosecute the at-fault thief.... suddenly everyone wanted the whole thing dropped. The leadership of the non-profit fire company withdrew their claim for damages.

Had thievery discovered in a small business. Manager blamed an employee and ALMOST got away with it. The kid was smart though, sensed something was coming... and when accused came to the boss with reports he could print from the system showing evidence that it was the manager changing system settings. That was years ago and the manager still has yet to see any real criminal consequence.

Five bucks says this charity had very poor internal controls that were often circumvented by ALL PARTIES and this made the case very weak. Would be interesting, yet boring, to see the details. I know the drill. Two signatures required on checks and the annual audit reveals the checkbook with the next 10 checks signed in blank so they are "ready to go". There goes your "two signatures required" attempt at internal control... and someone can circumvent the system even WITHOUT forgery.... which is what was alleged here.

This kind of revealed dishonesty and failure to follow-up and a push to "settle" is rampant... and everywhere.

Criminals are everywhere. This is a systemic problem in society.

I bet this isn't the ONLY time this guy stole, it is just the first time discovered. Also, he is dishonest in other areas of his life. That usually follows as well.

The real issue that the DA's Ofc never made public, he was "shaking down" us deputies for yrs. He, Cpt Tyrone Berry and the Chief Deputy (Ofc Manager) demanded $500 annual cash payments to remain w the Dept. This was Extortion, but anyone who complained and provided audio recordings of this Extortion to DA's Ofc were dismissed from Service and some even Indicted or brought before Grand Jury on various charges including Conspiracy or Actual Attempt to Bribe Public Official.
How is being Extorted a "bribe?"
I was even arrested at my house for Impersonating Public Servant because I complained to DA.
Their PC for arrest was that I was a Peace Ofr w their Dept and they sent a fax to Austin dismissing me from Office. Yet, they never informed me of this. So, I was working for them in an Official Capacity while they revoked my PO license w/o ever notifying me.
At pretrial hearing my Council introduced this Documentary Evidence proving that I was completely Innocent, and was Unlawfully Imprisoned. DA Ofc dropped charges, but I went for a yr w/o being able to work even as a Security Guard. The SOBs have kept my Personal Duty Gear for all these yrs and refused to return around $3,500 of my personal property, my DOD ID card, my Masonic ID card, my CCW and other forms of ID that they destroyed rather than following the Judge's Order to return to me.
My bail was originally $5k, but at 72hr Hearing the Judge raised it to $85k based upon DA request simply because I invoked 5th Amend and refused to Plead Guilty. He never even saw or spoke w me. Just announced change based upon DA petition.
Some system huh?

Why not be more selective? If only 1 in 50-1000 of us are bad, focus your attentions on THAT. Not ALL of us.
Continue your Education of the Public to the Horrors that some face. Inform them of the value of Jury Nullification and other Tactics/Strategies to combat Official Misconduct/Opression. You just may find that many of us in Blue hate dirty cops/officials just as much as you!

I don't hate all cops, just the crooked ones.

The stats are closer to 99% bad, with the good 1% run off in a hurry, most of the time. Honest cops get taken out, one way or another. If good cops hate crooked cops so much, why do they tolerate it, and in fact seem to condone it?

Here's a reasonable question: If 1/ 1000 KKK members are really great guys, would you be pro KKK? How about NAZIs? Oskar Schindler was a good man, are you a big fan of NAZIs? I promise you there were good and honorable men who stood on the side of Fidel Castro, so are you pro Castro/pro communist? A good many Japanese soldiers were good men, so should we not pay any attention to the Rape of Nanking? I personally met a goodly number of good muslims while in the Middle East, I am not pro islam, do you think I should be? Wow, that is a really egregious example then.

We recently have a new head of the prosecutor's office here. Follow-up on those kinds of theft cases has improved but it is slow going. Prosecution is still slow and constantly full of "delayed" court cases. I still rarely see consequence for these kinds of theft.

I can't speak of experience with that kind of abuse of power over a long time period. That is really heinous. I can imagine if you are not careful it could bring you to a rage. How in the world do you deal with it? Man, that is really sour. I feel bad for you bud.

Harris County Precinct 6 Constable Victor Trevino was indicted Friday on four felony charges. The 14 month long investigation of Trevino was sparked by our own 13 Undercover probe into his office.
13 Undercover started its work after an outcry from employees.
It was the constable's own employees who reached out for help, sending anonymous letters a year and a half ago begging, "please help us at Precinct 6." A former employee told 13 Undercover that employees felt pressured to donate their own money and their taxpayer paid time to Trevino's charity and his political campaign to keep the jobs your tax dollars pay them to do.
Former Precinct 6 employee Anna Nunez had a front row seat in Trevino's back office.

Wayne Dolcefino: You thought this was a shakedown?
Anna Nunez: Absolutely.

She personally collected some of the money from deputies; cash bound for Trevino's charity and campaign

"What made me upset was seeing officers on their own time pulling out cash and personal checks," said Nunez. "They all feared for their jobs."
Emails 13 Undercover unearthed last year show deputies complaining about Trevino's drumbeat for charity donations, "he's killing us," one wrote. Supervisors emailing underlings, "do I have to remind you who you work for?"
And when it came to spending charity money, Trevino couldn't provide many receipts. 13 Undercover showed thousands of dollars in checks cashed at east side convenience stores with little record of where the money was spent.
Wayne Dolcefino: When I see checks like this, you are not buying chips and drinks, you're cashing checks.
Constable Victor Trevino: That's possible.
Dolcefino: You are or you aren't?
Trevino: Of course.

Trevino dispatched his on-duty, uniformed deputies to serve eviction and property vacate notices. The money went right to the command staff with little to no record of where the money was spent.

If convicted, Trevino could go to prison for 24 years.
This is the latest in a series of county employees indicted on felony charges in the past year.

You probably remember the scene outside FBI headquarters just hours after former Harris County Constable Jack Abercia was arrested back in January. Abercia was charged in a 13 count indictment that accused him of bribery and conspiracy.

Just days before Abercia's arrest, former Harris County Commissioner Jerry Eversole pled guilty to lying to investigators as part of a deal to avoid jail time. He was originally accused of accepting bribes.

If you have any ?s the press accounts cover most answers. Yet no mention during the entire Investigation was made of those Deputies who complained "On the Record" and refused to pay the Extortion.
Many of us were convicted because the Dept controlled the documents. And if documents didn't serve their Narative, they simple distroyed them.
I was fortunate. They were sloppy in the way they handled setting me up.
Yet I could have served 3-5yrs if I didn't interview so many prospective Defense Councils before hiring one.
Many said that just being accused was sufficient and the fact that I WAS a Peace Officer at the time didn't matter.
My attorney was a former HPD Major Crimes Det and after retiring, worked as a prosecutor after passing the Bar. He knew the dirty tricks that the DA Ofc played and he was known as being a straight arrow.
The DA made me several offers, but I insisted on a trial by Jury. I knew that having Evidence entered into the official Court Record would show just how dirty things were including Ofrs who ran their own Underage Brothels and who ran "Exclusive Drug Distribution Franchises" in poor neighborhoods and Gov't Housing.
But that's another story. Just like the HPD Ofrs convicted of Rape continuing to ptrl and examples of victims of AgSexAsslt being persecuted by IAD for complaining. Then DNA evidence being found exactly where the victim said it was.
How did sperm and vaginal swabs end of on the exact Keymap page where they said they would?
But in a county w thousands of LEOs, even a 0.1% bad apple quotient would result in SOME cases. Yet, over and over again we learn of Mafia style rings operating w/i various Depts.

This story doesn't even scratch the surface of what all came out during the Investigation. On Duty Dpts chaufered his family around town, did his personal shopping including grocery shopping, shook-down store owners if they didn't want to suffer "Fatal Robberies," etc.
And though the story doesn't mention it, when Const Wooten went on TV he BRAGGED about his behavior. Saying, "I was elected to police my area the way "I" see fit. If that means I want Dpts shoping for my groceries and taking my kids to and from school, that just how it's gonna be done!

During the 1st few yrs there was a definite Cognitive Dissonance. It made me reevaluate my entire worldview.
Since childhood I was always a very "Law and Order" type person who viewes the world not so much in black and white, but various shades of gray. This incident shook me to my core. The realization that we didn't live in a fair and just society was simply too much to bear. So, I did a lot of reading and contemplation, as well as trying to stay busy and not give myself time to stew.
As Continuity says, Being a LEO is a way of life. A way to self identify, like some do with religion, Fraternities, etc. The word profession comes from the fact that certain Fields required a Profession of Faith before 1 could enter them in times past.
INstead of a Religious Profession, we now take a Civil Oath of Office. Yet it still retains a religious quality for many of us. That's why people who join our fraternity for impure reasons upsets many of us.
Cont told Trooper in another thread how upset he would be if someone showed their MIl ID hoping for liniency. I'm not that strict. But for a cop to run an Underaged Brothel or guarentying exclusive distribution rights to sell drugs in Gov't HUD housing...that REALLY grinds my teeth. When the weak are harmed, that's where I ALWAYS draw the line.
I truly see myself as an Guardian keeping my Wards safe from those who would harm them. That's why I wish we could focus more upon Public Safety, rather than victimless crimes.
But that's not the direction where Politics and Budgets allow us to go. Instead we seem to cast a wide dragnet and sweep most everyone up. Then the connected few get dismissed; while the unfortunates end up in Prison, Probation, or a costly legal battle.

How a guy can get away with such a long history of abuse is hard to comprehend. I guess some people have a certain gravitas and that gets matched up with people's nature to not be the one to upset "what everyone has"..... so he gets away with it?

I wonder if the same phenomenon is at work in something like the Jerry Sandusky case. People want things to just "go away" or "not be true" so they ignore it... and things go on for years and the wicked behavior blooms. They actually ENABLE and ENCOURAGE the behavior by ignoring the problem.

Not only do unfair consequences exist for people trying to do the right thing and reveal what this guy was doing...... no...... on top of that, to see a lack of appropriate consequences for the at-fault party really is sour... and perhaps encourages the NEXT generation of evil.
